Arizona Injury Lawyers Warn of Scottsdale Traffic Hold Up

As Scottsdale Injury Lawyers, we want everyone to be aware of some traffic hold ups in the Scottsdale area. Drivers in the Scottsdale area should be aware of an unusual traffic hold-up at Pima and Pinnacle Peak Road. The traffic hold up is a sinkhole at the intersection of these two roads. The sinkhole, which was discovered Thursday, is probably the result of an abandoned water pipeline line. Officials say it is not related to the road improvement project that has been taking place in the area. As work begins this week to repair it, as many as seven lanes of traffic will be closed. Typically roads closed lead to serious accidents so we want to inform everyone to be careful in these areas.

Many times traffic results in confusion and misunderstandings and serious injuries can result in this area if people are not careful. Scottsdale is generally a safe area but with a lot of construction going on the area is not free of accidents.

The sinkhole is occurring in the wake of a road improvement project, which seeks to increase safety measures, reduce traffic flow, as well as adding bike lanes and foot paths. Scottsdale is in Maricopa County, which has the highest rate of traffic accidents in the state - well over 60,000 per year. So far, no accidents or injuries have occured as a result of the sinkhole.

Arizona has continued to struggle with an ever-expanding population of drivers - and every day, accidents happen. If you have been injured on the road, then you need the counsel of experienced attorneys. As Scottsdale Car Accident lawyers we know the ins and outs of personal injury and wrongful death law. 6 Seriously Injured in Marana Rollover Crash

A blown tire caused a car accident Saturday, sending six of its passengers to the hospital with serious injuries (ABC15 08/20/2011). According to report, the Chevy Astro van rolled over a number of times around 3:20 p.m. on Interstate 10 near the Marana exit.

Two of the victims were flown in critical condition while four more were transported by ambulance after suffering serious injuries.

The engine compartment was on fire after the crash but was contained with the help of a bystander who used a fire extinguisher to prevent the fire from spreading.

Motorists had to be detoured after the accident caused Westbound Interstate 10 to be closed for several hours.

Rollover accidents which have a high fatality rate usually involve tall and narrow vehicles such as SUVs, vans, and pickup trucks. This is because of the higher centers of gravity that these types of vehicle possess making them more susceptible to rollovers.

While the accident above was triggered by a blown tire, Safecar.gov has outlined the most common factors that can lead to rollover accidents. Three of those factors are as follows:

  • Speed – Being involved in 40 percent of fatal rollover accidents in the country; excessive speeding is one of the common causes of rollovers. Make sure that you travel within speed limits to avoid becoming a victim of a rollover.
  • Alcohol – Impaired driving accidents have been a problem for the longest time. Alcohol consumption may impair a driver’s senses making him susceptible to a crash and should be completely avoided before driving.
  • Location – Almost 75 percent of fatal rollover accidents happen in rural areas because of higher speed limits and undivided road structures.

Rollover accident victims who wish to speak to an Arizona rollover accident lawyer can call (602) 457-6222 for a free consultation.

Two-Year-Old in Serious Condition after Glendale Near-Drowning Accident

A Glendale child near drowning accident sent a young boy into the hospital in serious condition after nearly drowning at their home near 47th and Olive avenues (AZ Family 08/22/2011).

The couple found their 2-year-old son submerged in water and rushed him to the hospital. It was unclear where the drowning accident exactly happened as the investigation is still ongoing.

Children that are incapable of swimming are at risk to drowning accidents. Drowning does not only happen in a pool or in a large body of water, it can happen inside your home. In fact there have been a number of reports of in-home drowning throughout the country. Baths and hot tubs and even buckets or other containers which hold water are considered drowning hazards.

To prevent drowning accidents from happening inside your home, please consider the following safety tips:

  1. Kids should never be left unattended during bath time.
  2. Keep water containers securely covered or empty them after using. Buckets kept outside can collect rain water which can be a cause of drowning.
  3. Though prevention is always better than cure, learning CPR can be a life saver. Educate yourself on how to properly handle a drowning emergency.

If your child has been a victim of an Arizona drowning accident and would like to receive compensation related to a personal injury, call (623) 455-6603 for a free consultation with one of our child drowning accident lawyers in Glendale.

1 Dead, 2 Hurt in 6-Vehicle Mesa Crash

A Mesa traffic accident involving multiple vehicles was reported earlier this week resulting in the death of one person and sending two more to the hospital (AZ Family 08/15/2011). According to police, the crash happened Monday morning at Southern Avenue and 24th Street.

Initial investigations revealed a man driving a pickup truck suffered some kind of medical emergency, causing him to lose control. His vehicle sideswiped two cars and continued to move on and hit another two before stopping. A sixth vehicle was hit by the debris of the second crash.

The driver of the pickup truck was killed on the scene while two more suffered serious, but non-fatal injuries. Investigators are still finding out whether the victim died of his injuries or his medical condition.

Though rare, a medical condition can be a factor to car accidents. According to the National Highway Traffic Safety Administration (NHTSA), seizures are the most common form of medical condition that leads to motor vehicle crashes. From 2005 to 2007, seizures accounted for 35 percent of such cases followed by black outs, diabetic reactions, heart attack, and stroke.

Furthermore, NHTSA states that drivers 65 years old and older are most prone to crashes resulting from medical emergencies.

Drivers prone to medical emergencies are advised to not travel alone or completely avoid driving to prevent such accidents from happening. It is also advised to avoid taking medicines which may have drowsiness or other impairing side effects.

Christensen Law Firm Creates Cycling Infographic

The Christensen Law Firm of Utah recently created an infographic about bicycle accidents and the injuries that often result. The Christensen Law Firm believes strongly in providing integrity and compassion to their clients that have been the victim of a Utah bicycle accident. This infographic helps to explain the importance of wearing a helmet and ways in which bicycle injuries affect a rider. The law firm represents numerous bicycle accidents ranging from cyclists, tri-athletes, and children that have been injured.

The infographic discuses the most common places to ride bikes, the reasons people ride, and statistics about helmet safety. The most common place to ride is on paved roads and the most common reasons people ride bicycles are for recreation purposes and exercise. Even though 48.1% of bicyclists ride on paved roads among cars, only 19 states require drivers to stay at least 3 feet away from cyclists while on the road.

Injuries on bicycles result in 580,000 emergency department visits every year. In 2008 it was reported that 91% of the bicyclists killed were not wearing helmets at the time of their accident. Research has found that helmets reduce to risk of head injury by 85% and severe brain injury by more than 75%. Two-thirds of accident deaths are from traumatic brain injuries.

Arizona personal injury and wrongful death attorneys Alexis and Mark Breyer, “The Husband and Wife Law Team”, represent numerous bicycle accident victims all over Arizona. If you or a loved one has been a victim of a bicycle accident please call for a free consultation.

The 4 Stages of Drowning

According to the Center for Disease Control and Prevention (CDC), each day about 10 people die from unintentional drowning. Drowning is the 6th leading cause of death for people of all ages. The CDC also reported that for every child that dies from drowning, another 4 received emergency medical care for a nonfatal incident.

Dr. Heidi Dalton, chief of critical-care medicine at the Phoenix Children’s Hospital recently explained what happens when a child is drowning.

Stage 1

Infants know not to get water in their lungs. Their strong reflex forces them to move quickly until they are exhausted or are forced to breathe because of the lack of oxygen. They will experience a sense of suffocation.

Stage 2

As the child starts to sink they breathe as the body’s natural response takes over. Children store less oxygen in their bloodstream which causes then to pass out faster than teenagers or adults.

Stage 3

The brain and blood continue to be deprived of oxygen which may cause cardiac arrest. In most cases, infants that have drowned do not have water in their lungs.

Stage 4

When pulling an infant from the water, parents or first responders need to restart the body’s breathing.

Dr. Dalton says that “the amount of time underwater does not determine whether a child will live or die. The fate of the child depends on multiple factors; including how long she was without oxygen and whether the heart had stopped.”

If you’re child has been involved in a drowning or near-drowning incident in Arizona the Phoenix child drowning accident attorneys of The Husband and Wife Law Team are available for a free consultation at (602) 457-6222.

Hay Truck Catches Fire on I-17

Fires are dangerous for anyone involved. According to information from the Centers of Disease Control and Prevention, in 2009 it was stated that there was on average one person died in a fire every 175 minutes and in every 31 minutes, someone was injured from it. Fires can start in many ways as well.

In recent news, the Arizona DPS says that Interstate 17 was closed after a truckload of hay caught fire (ABC15 08/12/2011). The hay fire from the truck also caused brush fires on areas surrounding the highway. At the same time, as firefighters were fighting to control the fire, the hay was spread out onto the road. It was reported that traffic on the northbound lane was backed up for 10 miles during the incident. A few hours later, the I-17 was reopened.

Luckily, no injuries were reported from the hay fire. However, the usual reason why people die in a fire is not because of the burns, but because of the inhalation of smoke and toxic gases.

3 Die in Fiery Collision on Loop 101

The risk of having fatal crashes rises when the driver decides to drink alcohol. According to the Insurance Institute for Highway Safety, there is a significant rise in the risk after 0.05 blood alcohol level (BAC) of a person. This is why all states have defined impaired driving with a BAC of 0.08 or higher in a law they have enacted. According to the Center for Disease Control and Prevention, the total of all traffic deaths related to impaired driving in 2009 was 32%.

In recent news, 3 people have been reported to have died in a collision in Loop 101 in Phoenix (AZFamily 08/13/2011). The accident happened at around 1:30 AM on the Loop 101 near Thomas Road. After the two vehicles collided, one car caught fire, killing the three occupants inside. The three occupants haven’t been identified. The driver of the other vehicle was taken to the hospital for treatment of a broken left hand. After he was released from the hospital, he was booked into jail for three counts of secondary murder. Police say he was impaired at the time of the accident and had a high BAC level.

If negligence or wrongdoing on the part of another causes the death of a loved one, you may be able to file a wrongful death claim. Building an effective wrongful death case in Arizona starts with proving that negligence or wrongdoing caused the fatal accident. In Arizona, there is a law against impaired driving. When planning to drink, it is better not to drive and instead take a taxi or ride with a sober friend driving.

Phoenix Rollover Seriously Injures 5

Rollover crashes are the deadliest of all types of crashes. Annually, an average of 10,000 people die from vehicle rollover accidents. According to the National Highway Traffic Safety Administration, rollover deaths in 2009 fell to 8,267. An estimate of 476 serious injuries is said to be prevented annually. Moreover, being ejected from the vehicle when not wearing a seatbelt attributes to a majority of rollover deaths. Almost 25% of fatal accidents are involved with vehicle ejection. Seatbelts will not reassure a 100% safety from crashes but it will minimize the impact. Some years prior to 2009, the overall rate of ejection in fatal crashes was only 2.5% for occupants who wore seatbelts compared to a whopping 29.4% for those who didn’t wear seatbelts.

In recent news, there was a two-vehicle rollover that occurred between Interstate 10 and 75th Avenue causing a temporary shutdown of both the east bound and west bound lanes (AZCentral 08/13/2011). Five people were ejected from both vehicles at 2:40 in the afternoon. These people sustained serious injuries. Further investigation will be done regarding this accident.

Rollovers are prone to happen with light vehicles and SUVs. Avoid conditions that will lead to loss of vehicle control like driving under the influence, drinking alcohol, speeding, etc. Always be careful on roads and avoid extreme steering of the wheels. Last but not the least, buckle up when out for a drive.

If you or a loved one has been involved in a vehicle ejection or a vehicle rollover accident in Arizona, there is free consultation. You may call (602) 457-6222 to talk to one of our rollover accident lawyers in Phoenix.

16-Year Old in Critical Condition after Phoenix Pedestrian Accident

All over the world, motor vehicle accidents are a serious concern. Every year many people die due to car crashes in the United States. Hence, fatal car crashes are the leading cause of deaths especially to those ages 5-34-years-old. The Center for Disease Control and Prevention (CDC) said that more than 2.3 million adult victims were taken to emergency departments due to injuries they acquired from such.

In most instances, when a pedestrian is involved in a car crash, there is a high possibility of sustaining serious injuries or sometimes, even death. Pedestrian-motor vehicle accidents in the country have been one of the major concerns of the government.

In 2009, pedestrian fatalities reached to 4,092. Although, the number seemed to be considered high, it is still good news that it has declined from 4,378 fatalities in 2008. The National Highway Traffic Safety Administration (NHTSA) concluded that in 2008 on the average, one pedestrian dies every 120 minutes and injured in a crash every 8 minutes.

Around 7 a.m. on Tuesday (8/2/11), a 16-year-old teen was in an extremely critical condition after he was hit by a car at Thunderbird Road and 23rd Avenue. According to the authorities, although the victim was in the crosswalk, he was walking against the signal causing him to be struck by the car.

Meanwhile, the driver did not appear to be impaired in any manner according to the authorities.

We know that despite of the decreasing number of fatal car accidents in the country for the past several years now, there are still threats that we should be careful of. Here are some pointers from CDC to help pedestrians like us prevent injuries and deaths due to motor vehicle accidents:

  • Pedestrians should be especially careful at intersections, where drivers may fail to yield the right-of-way to pedestrians while turning onto another street.
  • Pedestrians should increase their visibility at night by carrying a flashlight when walking and by wearing retro-reflective clothing.
  • Whenever possible, pedestrians should cross the street at a designated crosswalk. It is much safer to walk on a sidewalk, but if pedestrians must walk in the street, they should walk facing traffic.

If you have been a victim of a motor vehicle/pedestrian accident and would like to seek compensation, we are available at (602) 457-6222 for a free consultation. Call now and a pedestrian injury accident lawyer in Phoenix will be with you shortly.

1 Killed in Rollover Crash Near Loop 101 and U.S. 60

Rollovers are among the most dangerous types of vehicle crashes because of a high incidence of occupant ejection and head injury. Rollover crashes account for approximately half of all single-vehicles as compared to multi-vehicle crashes. It is even 36% higher than those crashes with no rollovers. According to the FARS (Fatality Analysis Reporting System), a total of 8,296 or 35% of passenger vehicle occupants died in rollover crashes in 2009. More than 90% of rollover crashes of passenger vehicles are single types.

In recent news, a single-vehicle rollover caused an accident involving seven people on Loop 101, near
U.S. 60, with one dead, AZCentral reports Friday afternoon. Five adults and two teenagers were in the vehicle, five of which were ejected and the remaining two had to be extricated. Officials say the one who died was 40 years old while the other six survived without life-threatening injuries. The accident occurred at around 12:30 p.m. when the driver lost control of his vehicle. The Arizona Police Department suspects it was tire failure that caused the accident. The northbound lanes were temporarily closed but were reopened at 3 p.m. the same day.

Factors that may also contribute to these rollover crashes would be reckless driving behavior, poor road design and vehicle type, with SUVs and light pickup trucks being the most prone to these type of crashes. Buyers should be always aware of the pros and cons of choosing a car to purchase.

Pickup Driver Dies after Smashing into Semi Truck

Truck accidents in the United States have slowly been decreasing over the past few years. In 2009, almost 18,000 light trucks were involved in fatal crashes nationwide, a decrease of about 1,200 from 2008. Accidents involving large trucks have also declined to around 1,000 vehicles in the same year.

Based on study, truck accidents, unlike other motor vehicle accidents which are often caused by alcohol, distracted driving, and speeding are primarily caused by lack of sleep and fatigue on the part of truck drivers. In fact, only about 1 percent of truck accidents involved an alcohol-impaired driver.

Although statistics show that truck accident fatalities are not as high as other motor vehicle fatalities, being involved in one can be very dangerous. It can result in serious injuries such as burns, paralysis, spinal cord injuries, traumatic brain injuries, or even death.

On Wednesday evening, just before midnight (08/03/11), a pickup truck slammed head-on into a semi truck. The Glendale truck accident happened near 75th Avenue and Bethany Home Road around 11:30 pm. Police investigation revealed that the pickup crossed the median and slammed into the parked semi truck on the roadside. The driver of the pickup died on the scene.

DUI Arrest Warrant Issued For Ex-UA Golfer in Tucson

It is never safe to be driving under the influence of alcohol (DUI). Either those involved comes out of it injured or worse, killed. Alcohol is a contributing factor in almost half of all traffic fatalities. During 2009, according to the NHTSA (National Highway Traffic Safety Administration), those in DUI cases accounted for 10,839 out of a total of 33,808 fatalities. This was a 7.4% decrease compared to the year 2008. Among the alcohol-impaired drivers, passenger cars involved were 4,242; slightly lower than that of 2008 of 4,679.

In recent news, a 19-year-old ex-UA golfer was issued an arrest warrant for failing to appear in court on the 19th of May for drunk driving in Tuscon. She was a native of Zurich, Switzerland and a former member of the University of Arizona women’s golf team. Young drinkers ages 20 to 30 comprise more than half of all impaired drivers involved in fatal crashes and have been shown to have the highest average blood alcohol concentration (BAC). Drunk drivers are a risk to themselves and to others, so think twice again if a friend or an acquaintance is out having a bit of fun.

One of the two other people was a 17 year old girl, who got out of her car on her own and was also rushed to the hospital. A section of the 7th Street south of Thunderbird Road was closed that day from morning till 2 p.m.

Accidents could have been prevented or avoided. However, most would blame it for example on equipment failure or poor roadway design but that’s hardly the case. There are always equipment repairs and roadway maintenance done at a designated time for each city. It’s primarily the driver’s behavior that makes a difference.

Suspected DUI Crash Kills Woman in Peoria

A Peoria accident resulted in the death of a woman Tuesday morning when her car collided with an SUV at Peoria Avenue and the off-ramp from Interstate 17 (AZ Central 07/19/2011).

Phoenix Police Department said the accident happened just after midnight while the 45-year-old victim was driving her 2005 Ford Mustang north into an intersection. A 1996 Toyota 4Runner then struck her on the driver side sending her to a local hospital where she was later pronounced dead.

Initial investigations point at impairment as a factor in the crash. The driver of the SUV was suspected by Police to have failed to stop at a red light.

With 32 percent of car accident deaths in the U.S. associated with alcohol impairment (National Highway Traffic Safety Administration), it is alarming to see that drunken driving accidents continue to happen. In Arizona, alcohol impaired driving fatalities made up 27 percent of total vehicle crash deaths in 2009.

In an effort to decrease drunk driving accidents in Arizona, authorities continue aggressive campaigns against people driving under the influence. Last year a statewide task force was held to monitor holiday DUI which resulted to thousands of arrests.

But despite this, a number of drivers continue to abuse alcohol and put everyone’s lives on the road at great risk. Report drivers who you suspect are driving under the influence to local authorities to prevent such accidents from happening.

Victims of impaired drivers who seek compensation related to a personal injury can call our Peoria car accident lawyers for a free consultation at (602) 457-6222.

Phoenix Tanker Truck Rollover Closes I-17

An early morning truck accident happened recently which caused both lanes of Interstate 17 at Dunlap Avenue to be closed for hours (AZ Family 07/01/2011). According to report, the rollover happened around 1:20 a.m. when a truck heading north lost control, flipping over the median wall and into the opposite lanes.

The truck was carrying 9,000 gallons of fuel and created a potentially explosive situation. Hazardous Materials crews were able to confirm a gas leak but not as much as expected. The leak reached both sides of the median but responding crews had it under control. Another tanker was used to transfer the fuel from the rolled over truck.

The driver sustained minor injuries and was already released from the hospital. No one else was reportedly hurt in the Phoenix truck accident.

It took hours before the lanes were reopened as Hazmat crews had to clean up the area and transfer the remaining fuel to another tanker.

Back in 2009, the National Highway Traffic Safety Administration reports that 3,215 large trucks were involved in fatal car accidents. Large trucks took up 7.1 percent of total vehicles that ended up in fatal crashes.

With the high fatality rate of rollover accidents, it is fortunate that the driver survived with only minor injuries and that no one else was hurt in the incident. Vehicles that are taller and narrower in size are at a greater risk of ending up in a rollover crash. To protect yourself from a rollover crash, make sure to follow appropriate speed limits as rollovers tend to involve excessive speeding.
