Arizona Auto Accident Law

In Arizona, there are two possible kinds of legal damages that can be pursued by an injury victim. Aside from property damage, there are compensatory damages and punitive damages. Compensatory damages are for pain and suffering as a result of an injury. Punitive damages are not pursued in every case because it is a punishment for the at-fault party. Punitive damages are made to make the at-fault party accountable for his actions. The actions must be shown to be with an "evil mind and hand."

Four Tips to Avoid a Right Cross Bike Accident

The right cross is considered as one of the most frequent ways to get involved in a bike accident. There are 2 possible ways that the right cross can happen. The first is when the bike is in front of the car as it hits the bicycle and the second is where the car drives in front of the bike and the rider crashes into the car. Here are ways to avoid this type of bike accident in Arizona:

  1. Use headlights when riding during nighttime. It is also recommended to do this even in daytime as the flashing mode can make the rider more visible.
  2. Whenever there is a car approaching, it is recommended to signal them. In this way, they will know that you are there and decrease their speed.
  3. Don’t speed up if you can’t make communication or contact the driver. This is particularly the case at night. When you cannot make eye contact with the driver of the automobile, you should slow down.
  4. If the driver is not looking at the curb or at the bike lane, it is a must that your ride further left. In this way, when you begin pulling out, you can get out of the way and avoid a collision.

3 Killed in Wickenburg Head-on Collision

Motor vehicle accidents are often caused by negligence on the part of a driver. Driving at a high speed or driving while impaired are two relevant factors when it comes to fatal car accidents. In the United States motor vehicle crashes are the leading cause of death among ages 5-34 years old. This is based on the research conducted by the Centers for Disease Control and Prevention (CDC).

Nearly 34,000 persons were killed in fatal car crashes in 2009, according to the National Highway Traffic Safety Administration (NHTSA). In addition to that, more than 2.3 million were reportedly injured in car crashes and were treated in emergency departments.

In Arizona, fatal car accidents are very common with 698 reported fatalities in 2010. The Arizona Department of Transportation also stated that based on the records, speeding is a common violation of drivers which resulted to motor vehicle crashes.

On September 20, 2011 at around 8:41 pm, an Arizona speeding collision between a 1995 Ford Explorer and Chevrolet Lumina occurred in Wickenburg. According to authorities, the SUV was travelling southbound at high-speed when it struck the Chevrolet Lumina, and a DPS vehicle. Authorities said that the SUV might have been trying to pass other vehicles before it hit the Chevrolet head-on. The driver of the DPS vehicle and two others died at the scene.

As drivers, we are expected to be extremely careful while we are behind the wheel. In most instances, a seemingly simple and thoughtless act can cause serious injury and even death. Running a red light, speeding, and failing to yield or stop for a pedestrian are potentially deadly forms of negligence.

Car Crashes into Famous Hotdog Shop in Glendale

AZCentral reported a possible impaired driving accident in Glendale involving a vehicle crashing into a popular hot dog shop on September 14, 2011. According to report, the crash happened at about 5:30 p.m. Tuesday as the 20-year-old driver was headed east on Glendale Avenue.

The driver lost control and veered off into a dirt field across from the hotdog shop and then came crashing into the west side of the store. A gas line was damaged, but crews were able to control the situation and evacuate the area.

Police suspect alcohol to be a factor in the Glendale accident and are waiting for blood test results. The driver sustained serious but non-fatal injuries and was taken to a local hospital for treatment. No one else was reportedly hurt in the crash.

Impairment has always been a major concern in road safety. According to the Centers for Disease Control and Prevention (CDC), about 30 people die each day because of alcohol impaired driving in the U.S. Aside from the injuries and deaths, impaired car accidents have an economic impact as well; CDC estimates that the annual cost of alcohol related accidents exceeds 51 billion US dollars.

As Arizona DUI crash victim attorneys, we urge everyone to be an instrument in the fight against impaired driving accidents by avoiding alcohol when driving and by not allowing a friend or a loved one to drive when impaired.

1 Killed, 1 Injured in Phoenix Motorcycle Crash

Based on the National Statistics from 2009, there were 5,430 bikers who were killed, that is an increase of 2% from the data in 2008. Based on research, helmets are estimated 37% effective in preventing any serious injuries to motorcycle riders and 41% for motorcycle passengers.

According to AZCentral report, a motorcycle crash occurred at 4 am on Saturday. The unidentified 22 year old male motorcycle driver and the 21 year old female passenger were heading east bound on McDowell Road when a 2003 Ford Expedition driven by a woman was traveling westbound on McDowell in the left turn lane to turn onto the southbound Arizona 143. The driver of the car did not stop at the red light left-turn arrow and turned in front of the 1980 Yamaha motorcycle. As the motorcycle driver tried to avoid the Expedition , they went down and both people in the motorcycle slid into the side of the vehicle. Neither were wearing helmets, which left the man dead, and the woman critically injured. The police don’t believe that impairment was a factor in the crash.

It is important that in driving a motorcycle both the driver and the passenger should always wear a helmet, always stay focus while driving. If one feels tired in the middle of the night or feels sleepy one must pull over to rest for a while. However, as experienced fatal motorcycle accident attorneys in Phoenix, we understand that even taking all available safety precautions can’t always prevent a crash, especially when another driver violates right-of-way and traffic laws.

If you have lost a loved one in an Arizona motorcycle accident caused by the negligence of another driver, you have the legal right to pursue damages through a wrongful death claim. Eloy Woman Killed in Single Vehicle Accident in Casa Grande

Speeding combined with alcohol consumption is a road violation which becomes much worse when other civilians are involved. NHTSA has an estimated economic cost of $40.4 billion per year in speed-related crashes alone. In 2009, speeding was a contributing factor of 31% out of all fatal crashes. However, speed-related crashes showed a decrease of 10%, from 11,767 in 2008 down to 10,591 in 2009.

In recent news, a 40-year-old woman was killed early Saturday morning in a single vehicle drunk driving accident in Arizona just south of Casa Grande (AZCentral 09/10/2011). Sierra Trucking Company Truck Crash Kills 3 on I-10

Commercial trucks are often going from Arizona to California. There have been many fatal car accidents between commercial trucks and innocent individuals who are traveling in smaller motor vehicles.

Recently, there was a fatal car accident in Arizona that took place on Interstate 10 near Picacho Peak. The trucking accident with the Sierra Transportation company semi truck occurred on September 8, 2011 and it is reported that the vehicle went through the median and crashed into a mini van that was traveling on the other side of the median. The Arizona Department of Transportation has reported that the minivan burst into flames and that there were three occupants in the vehicle that were killed. Reports have differed about the status of the truck driver in the Sierra Transportation Truck. Some reports have the truck driver of the truck in critical condition and others have reported that the truck driver suffered fatal injuries. There was another truck driver involved as well in the accident. Police are investigating the matter, trying to determine exactly what happened and how the second truck is involved in this fatal Arizona truck accident.

Fatal accidents like these with big transportation vehicles are very difficult for all parties involved. Many truck drivers are fatigued and that is a main factor in many fatal accidents, although other truck accident causes in Arizona are also common. At this time it is unknown what happened to the Sierra truck driver and why he crossed through the median.

There are federal regulations that must be followed by truck drivers. Federal regulations went into place some time ago because truck drivers, not just in Arizona, but throughout the United States, were driving so many hours that they were very fatigued and causing very serious accidents. Thus, federal laws were implemented that mandated the hours truck drivers were allowed to drive. Beyond that, truck drivers are required to keep logs on if their days traveled, miles traveled and times traveled. They cannot go over a certain amount of hours. Valuable evidence can be contained in the truck that will tell the families and loved ones of this tragic Arizona truck accident; what happened and what caused this fatal car accident with the Swift truck company vehicle.

All trucking companies must obey federal regulations to make sure that drivers are not fatigued. We will all have to wait to find out the exact cause of this crash to know whether it was an Arizona truck driver fatigue accident. Other helpful trucking documents may give more information about the driver of the vehicle as well. These documents can be destroyed within certain time frames if an experienced truck accident lawyer in Arizona does not do what is necessary to make sure that the company does not destroy valuable evidence. This is not to say that Sierra Transportation would deliberately destroy the documents, but many times trucking companies have in place to destroy documents within a certain time period so the evidence cannot later be used against them. In addition, there should be a black box in the truck that holds a lot of data about what the truck itself was experiencing before the driver lost control of the vehicle. This black box has data that a semi truck lawyer must get a hold of immediately.

There are some lawyers who practice trucking law nationally; however, almost always those lawyers will consult with a trucking attorney in Arizona. It is important to make sure that if you have a trucking accident that you talk with a lawyer who is licensed in Arizona. Otherwise the lawyer that you hire will most likely hire another lawyer in Arizona and as the client you would not have any idea of the actual lawyer who is trying your case. It is important that if you have loved ones who have suffered a wrongful death as the result of a trucking vehicle that you ask very important questions to make sure that you are hiring the best lawyer for your trucking accident claim. Ask the lawyer you are considering hiring if they are admitted to practice law in Arizona. Ask the lawyer you are considering hiring if they practice in federal court. Ask the lawyer you are hiring what experience they have with trucking accidents. These are some questions that will help you determine if you are hiring the best lawyer for your Arizona trucking accident claim.

To reach The Husband and Wife Law Team and to talk to an experienced Arizona trucking accident lawyer, call today at 602-457-6222. Mark Breyer is a certified specialist in injury and wrongful death law. He is an experienced trucking accident attorney and can answer all your questions. 10-Year-Old Girl Victim of Hit and Run in Surprise

According to the National Highway Traffic Safety Administration (NHTSA), one in every five children from 5 to 9 years old were killed in pedestrain road traffic accidents in 2008. Motor vehicle crashes are the leading cause of death among American children and young adults. In 2009, pedestrian-motor vehicle crashes accounted for 59,000 reported injuries and took the lives of 4,092 victims.

Pedestrian fatalities have dropped by 22 percent since 1998. Despite all of this, we still cannot be assured that pedestrians are any safer. There are a number of possibilities that we have to consider such as the number of people walking, how often and where they walk. This is to be certain that the decline is indeed a good one.

Did you know that three out of for pedestrian fatalities happen in urban areas? In Arizona, 155 pedestrians were killed and 1,236 were injured in 2010 according to the Arizona Department of Transport (ADOT). Out of these numbers 101 Arizona pedestrian fatalities and 1,135 injuries occurred in urban areas.

On Tuesday evening (09/07/11), a 10-year old girl was struck by a Toyota Camry while walking in a crosswalk. The girl was walking at West Point Parkway and Rimrock Street, northwest of Dysart and Greenway roads in Surprise. Police authorities revealed that the driver of the vehicle reportedly got out of the car to check on the girl but left immediately.

The girl was taken to the hospital by helicopter while the suspected driver was taken into custody by the police.

Fatal Motorcycle Accident Kills Rider in Phoenix

A fatal motorcycle accident has shocked Phoenix last week after a motorcyclist ended up through a windshield after colliding with an SUV (ABC15 08/29/2011).

Police received reports of a crash at 12th Street and Northern Avenue around 8:20 p.m. Monday night. Initial investigations reveal the accident happened after the SUV heading west on Northern Avenue failed to yield while turning to the motorcyclist who was travelling eastbound. The 23-year-old victim was rushed to a local hospital but was later pronounced dead.

Responding officers say the victim was wearing a helmet when the fatal accident happened. Tests were carried out to determine if impairment was a factor but the SUV driver tested negative.

Motorcycles pose a number of advantages over automobiles. They can easily pass narrow passages and are cheaper on gas. Some would prefer a motorcycle over a car just because of the different riding experience it offers. But motorcycles leave riders with limited protection; neither an air bag nor a seat belt is present to protect them during a crash.

Statistically speaking, motorcycles do have a higher fatality rate compared to automobiles. According to the National Highway Traffic Safety Administration (NHTSA), approximately 72 in every 100,000 registered motorcycles end up in fatal accidents as opposed to only 13 for cars.

These numbers are not meant to discourage motorcycle riding but rather to promote a “safety first” mindset. Wearing proper protective gear such as DOT-approved helmets, avoiding alcohol and speeding, and staying alert on the road are a few of the best ways that motorcyclists can enjoy a safe ride on the road.

If you have lost a loved one in a fatal Arizona motorcycle accident that was caused by the negligence of another driver, our Phoenix motorcycle accident wrongful death attorneys at the Breyer Law Offices, P.C. may be able to help. Call us today at (602) 457-6222 for a free consultation.

Children Sustain Serious Injuries in West Phoenix Collision

According to the New Registration Database (NRD) of the National Highway Traffic Safety Administration (NHTSA) in 2009 there are 24,474 people killed due to car crashes annually.

ABC15 reports that there was an accident that happened last Wednesday night just before 10 in the evening. It involved two vehicles in which the collision happened in the intersection of 75th Avenue and Van Buren. It was stated that the reason behind the collision was failure to stop on a red light. The police reported that a man was traveling with his three young children in the vehicle, it was said that none of the children were wearing seat belts.

Due to the accident a 4-year-old child sustained fatal injuries, while the 6 year old and the 7 year old were able to escaped and sustained minor injuries. The 55 year old driver which was the father of the children was as well transported to the hospital, while the 26 year old driver of the second vehicle didn’t receive any serious injuries and is still under investigation whether or not impairment was a factor.

Why are DUI Convictions Rare among Drugged Drivers?

As experienced DUI accident victim attorneys in Phoenix, we are well aware of the dangers of driving under the influence. Drugged driving accidents have been a growing concern all over United States. Reported incidents of drugged driving in the country demonstrated the possibility of becoming a leading cause of road traffic accident injuries and fatalities. According to the National Highway Traffic Safety Administration (NHTSA), one-third of drivers killed in fatal car crashes in 2009 tested positive for drug use.

In the United States, Driving While Intoxicated (DWI) leads to approximately 1.4 million arrests every year. In most states, DWI offences include both alcohol and drug use. Marijuana is said to be the most prevalent substance found among impaired drivers next to alcohol.

Despite the risks that drugged driving poses toward road users, it is still hard for offenders to get convicted. Unlike alcohol-impaired driving which has breathalyzers and a 0.08 BAC level as the basis for being impaired, drugged driving offenses are mostly unspecified and unclear.

Sgt. Paul White, a DRE for the Maricopa County Sheriff's Office revealed that most drivers suspected of being high on prescription drugs manage to get-away and escape convictions. In Arizona, a license is immediately suspended once the driver is proven drunk with BAC level higher that 0.08.

Aaron Harder, the Bureau Chief for the Maricopa County Attorney’s Office Vehicular Crimes Unit, also admitted that drivers using drugs, either prescription or illegal inside their bodies during a motor vehicle crash will not cause their licence to be suspended for 90 days unless they are proven to be guilty of DUI.

If you have been the victim of an alcohol or drug-impaired driving accident and would like to seek compensation, the experienced DUI accident lawyers in Arizona at the Breyer Law Offices, P.C. are available at (602) 267-1280 for a free consultation.
