How Trick-or-Treaters Can Avoid Pedestrian Accidents on Halloween

The Phoenix pedestrian accident attorneys at Breyer Law Offices, P.C., wish you and your families a fun, safe Halloween. Every year, pedestrians fill the streets of Phoenix to show off their costumes, spend time with friends, and most importantly: trick-or-treat! In fact, at least 2,000 people walked the streets Saturday night for Halloween-related festivities, according to ABC 15, and thousands more will be out on Halloween night.

Arizona Pedestrian Accident Statistics

According to a study put out by the Arizona Department of Transportation (ADOT), there were 124 pedestrians killed and 1,423 injured in 2008. The majority of those killed and injured were teenagers and young adults, and most pedestrian accidents happened in urban areas like Phoenix. Interestingly, the majority of pedestrian accidents took place in clear daylight, but accidents also frequently happened at night on poorly lit streets. This should be a warning to parents who may think that allowing their children to trick-or-treat in daylight is safer.

Tips for Safe Trick-or -Treating

Parents’ greatest fears on Halloween night include having their children hit by cars. Here are some ways to avoid an Arizona child injury this Halloween:

  1. Walk with them as they trick-or-treat and make sure they cross streets under your supervision only. Hold their hands as they cross.
  2. Dress them in reflective material or attach lights to their costumes so they are more visible to motorists.
  3. Have them carry bright flashlights inside their candy bags and keep them on at all times.
  4. Trick-or-treat on quiet streets instead of busy roadways.
  5. Travel in large groups; trick-or-treat with friends and family members.
  6. Stay on the sidewalk and only cross at well-lit, designated crosswalks.

San Tan Valley is far from Phoenix, but is an area where many car accidents take place. On Monday, October 24, ABC15 reported a rollover crash on San Tan Valley Road when two vehicles collided head-on at Gary Road near Hunt Highway and caused the involved van to rollover and eject its driver. Two victims were injured and were airlifted to a Scottsdale hospital. The ejected male victim was in critical condition. It appears that the other victim, a female, admitted that she was intoxicated when the accident happened.

We hope that both victims will recover quickly from all their injuries and want to remind everyone to never drink and drive.

As mentioned earlier, based on the recent data from NHTSA, fatal rollover crashes in Arizona has declined in 2009. In fact, fatal rollovers only represent 26% of the overall fatal crashes in 2009. The first vehicle that struck the man stayed on the scene to check on the man and helped by waving at cars so the man would not get hit again. However, a second vehicle struck the man and then fled the scene. The first driver has not been cited. The pedestrian was not walking in the crosswalk and was said to have been impaired. Traumatic Brain Injury Statistics in USA
According to the Centers for Disease Control and Prevention, each year about 1.7 million people suffer from traumatic brain injury, with 11% due to violence.

Arizona Personal Injury Law
Under the law, if a person injures another, the negligent party may be liable to the injured person for compensation for their injuries. Compensation can cover medical bills, lost wages, permanent injuries, and pain and suffering. The injured person generally must prove that the person who caused the injuries was negligent. If, for an assault, the person deliberately tried to hurt someone, the insurance company would not cover the injuries. If, however, the person was using a weapon to try to waive off another individual and hurt him or her by accident, the insurance would be responsible. When it comes to assaults cases, the specifics of each case really matter to determine whether or not a party can be held as negligent and liable for compensation.

Glendale Car Seat Usage Increases

The Glendale car accident attorneys at Breyer Law Offices, P.C. were glad to hear more and more people in Arizona have been using car seats for their children and paying attention to whether or not they are installed correctly. Also, adult drivers and passengers are using safety devices more and more. This is based on the statistics from Arizona Department of Transportation (ADOT) wherein it was reported that there was a slight increase in the number of drivers and passengers using safety devices in 2010 as compared to 2009.

On Friday morning, October 14, the third annual Arrowhead Ranch Car Seat Checkup was conducted at Arrowhead Ranch Plaza in Glendale. The inspection was conducted by the Glendale Fire Department, Arrowhead Ranch Plaza, Safe Kids Maricopa County and Sanderson Ford. The project aimed to help and educate parents on the proper use of safety seats for their children as well as to make sure that the seats were properly installed.

Phoenix Celebrates National Teen Driver Safety Week

The Phoenix car accident lawyers at Breyer Law Offices, P.C. are joining in for the recognition of National Teen Driver Safety Week (NTDSW) which started in October 2007. This year’s theme is supporting parents in teaching their teens to drive safely. NTDSW aims to make everyone aware of the threat of teen driving fatalities and to find possible solutions for this problem.

According to Linda Gorman of AAA Arizona, there are three primary factors that cause fatal car accidents among teens: distracted driving, failure to reduce speed, and failure to yield. Teen drivers are usually inattentive and will text, talk with a passenger, or play with the radio while driving.

Car Accident Statistics Involving Teens in Arizona

The National Highway Traffic Safety Administration (NHTSA) revealed that motor vehicle crashes are the leading cause of fatalities among American teens. The Arizona Department of Transportation (ADOT) reported that of the 406 drivers killed in fatal car accidents in 2010, 19 were ages 15-19 years old. Meanwhile, there were 3,078 reported injuries in the same year. These numbers were less than 2009 where there were 31 deaths and 3,290 injuries of drivers 15-19 years old.

Child Killed in Possible DUI Collision in Chandler

An experienced Chandler car accident wrongful death attorney will be able to help an individual with claims regarding the negligence of another party which results in the death of a loved one. Fatal accidents are very tragic events and the attorney you choose to hire can make the difference for your family, not just in terms of the settlement, but also in terms of the family's emotional experience.

We were saddened to hear that, according to AZCentral, an 11-year-old boy has been killed due to a collision between the family’s SUV and another vehicle suspected to be driven by an impaired driver. The victim was riding with his 7-year-old brother and father who was an on-call doctor at a local hospital. The family was on their way to the hospital and the father had to bring his two sons along because he didn’t have a babysitter. The offending driver was first spotted leaving a bar and was followed by police until he sped up and then collided with the SUV at the intersection of McQueen and Warner roads where he ran a red light. The 7-year-old child is said to be in critical condition, while the father has already been released from the hospital.

As Chandler wrongful death car accident lawyers, we believe there is absolutely no excuse for people to drive drunk and kill innocent people, especially a child. If reports are correct and the driver was intoxicated, he should be criminally punished and justice should be served. As an attorney, I would also tell the family that they may have a claim against the establishment where the driver was drinking and driving. Many people do not realize that establishments have a duty to make sure people are not leaving their establishment and drinking and driving. Depending on the actions of the city police, there may be a possible claim against the police if a high speed chase was involved. At this time, it does not appear that we have enough information on these various claims.

DOT Bike-Safety Plan Aims to Minimize Arizona Bike Crashes

Arizona bicycle accident lawyers at Breyer law Offices were surprised to learn that Arizona is considered to be a state that is unsafe to ride a bike. Based on reports by the Arizona Department of Transportation (ADOT), there were 1,914 bicycle accidents in 2010 with 19 reported fatalities.

On September 17, 2011, AZ Central reported on ADOT's bike-safety plan which aims to lessen pedacyclist fatalities. The report shows the details of the plan and how it will help in minimizing bicycle-related injuries and fatalities.

Arizona Bicycle Accident Statistics

Being considered as one of the deadliest state for bicyclists is not a good thing. However, bicycle accidents in Arizona havr shown improvement from 2009. Bicycle fatalities in 2009 accounted for 3.10% of the total crash fatalities while injuries reached 1,643. There was a slight decrease in 2010 with 19 fatalities and 1,583 injuries.

ADOT has enumerated the factors of Arizona bike accidents and found some interesting trends. The most common factors of bike accidents are failure to yield when vehicles are turning right and when cyclists are travelling while countering traffic.

Arizona Bike Law

The state of Arizona has bike laws that act as guidelines that need to be followed by cyclists. Bicyclists must adhere to such laws, including stopping for traffic lights and stop signs (ARS 28-644), the use of appropriate headlight and reflectors (ARS 28-817), yielding to pedestrians at crosswalks (ARS 28-792). Arizona bike accident lawyers at Breyer Law Offices can tell you more about Arizona's bike laws which can be used against those who have caused injuries to another.

The Importance of Motorcycle Riding Training

Arizona Motorcycle Riding Training

As Arizona motorcycle accident lawyers, we know that there are many accidents that take place that can injure motorcycle riders. While many survive unscathed or sustain only minor injuries, there are others who endure life-threatening injuries or who are killed because of a motorcycle accident. Many times accidents involving motorcycle riders are the fault of the driver of the other vehicle involved in the accident. That being said, we highly recommend motorcycle riding training for all motorcycle riders.

Why Get Rider Training?

One reason why some motorcycle accidents happen is because motorcycle riders tend to overestimate their skills when it comes to riding a motorcycle. This in turn gives them a false sense of security when on the road. Though it is essential to be confident when riding a motorcycle, a rider should know his or her limitations.

Most motorcycle safety advocate groups realize the importance of motorcycle safety courses and encourage every rider to partake in a training class. Participating in a motorcycle safety course can allow you to put yourself in a situation where you can react faster to another person's negligent actions. This is not to say that if you do not take a safety course for riding a motorcycle that you will be at fault for the accident, but it is intended to give motorcycle riders a better idea of safety precautions when riding their motorcycle.

Arizona Motorcycle Accident Statistics

According to the Arizona Department of Transportation (ADOT), in 2010 there were 2,735 motorcycle accidents, which comprised 2.5% of total crashes in Arizona.

Arizona Motorcycle Training

To become an Arizona licensed motorcycle rider, the state requires applicants to undergo training and a series of tests to determine whether the applicant is fit to ride a motorcycle on the road. Motorcycle licenses are composed of different classes depending on age and skills.

As Pinal County car accident attorneys, we are familiar with the factors that can lead to a crash; one of them being poor weather conditions. Just recently, a massive dust storm hit I-10 south of Phoenix causing multiple crashes, killing one, and leaving a number of people injured.

As reported by AZ Family, the incident took place Tuesday, October 4, 2011, when the dust storm surged into the area and reduced roadway visibility. The Department of Public Safety (DPS) stated that 16 vehicles were involved in the multiple car wrecks.

It was reported that the man was with his wife at the time of the crash and that she was in critical condition. In addition to these two individuals, others were injured as well.

The wreck closed the freeway and the DPS advised motorists to take State Route 79 as an alternative roadway.
