Many Arizona Construction Site Injuries Caused by Electrocution

As Arizona construction site accident attorneys, we see injuries caused by all sorts of accidents on the job. One type of injury we’ve seen in multiple cases involves electrocution or electric shock due to failures to follow proper safety precautions or shoddy workmanship. If you’ve been injured due to bad wiring on a construction site, you probably have a lot of questions, like what your rights are and whether or not you can hire a personal injury attorney to file a claim.

If you’re looking for answers, then you should at least consider consulting with a construction site accident attorney who has experience dealing with cases involving electrocution or electric shock. Depending on your unique circumstances, you may be limited to simply filing a workers’ compensation claim. Or you may have a valid personal injury claim, which may be very likely when the case involves wiring since a subcontractor is typically responsible for this task.

If you have been electrocuted on an Arizona construction site and you don’t know where to turn, please contact Breyer Law Offices. We have experience in all kinds of construction accident cases – including those involving electrocution and electric shock – and can give you honest answers and guidance, as well as educate you about all of your legal options, so you can make the best decision for you and your family.

Tucson Injury Attorney Says that Improper Use of Heavy Equipment Leads to Construction Site Accidents

Using heavy equipment is part of the job on an Arizona construction site. Forklifts, bulldozers, cranes, and other pieces of heavy equipment, are commonplace. In many cases, these accidents are the result of improper use or recklessness, and as a result, preventable.

When Tucson machinery construction accidents do occur, many injured people don’t know where to turn. Should they hire a personal injury attorney with experience in construction site accidents, particularly those involving improper use of heavy equipment?

Scaffolding Accidents Discussed by Mesa, Arizona Construction Accident Attorney

Construction sites are among the most dangerous places to work, and often workers suffer severe injuries on the job site. This often can be due to the improper use or maintenance of scaffolding, which can contribute directly to an injury or even death for someone on the job site.

Most constructions workers know that they have a right to file a workers’ compensation claim in Arizona. In Arizona cases where injuries have occurred on construction sites due to scaffolding issues, a claim can be made in addition to a workers’ compensation claim that can benefit the worker and their family. Many workers do not realize that they may also have the right to file a personal injury claim in addition to the workers’ compensation claim.

Determining whether a worker has the right to file a claim for an injury that occurred due to a scaffolding issue often requires the assistance of an experienced personal injury attorney that is knowledgeable about construction site injuries.

Should you know someone who has suffered from an injury or lost a loved one because of a construction site scaffolding accident, or if you have been involved in a construction site accident, we urge you to contact us. Our Mesa scaffold accident injury lawyers will tell you honestly if we believe no case exists. Most of us who don’t work on construction sites don’t realize just how dangerous they are. Many times, accidents cause serious injuries and sometimes even death. One contributor to construction site accidents in Phoenix is misuse of scaffolding.

Tucson Injury Attorney Discusses Lack of Protection from Falls by Workers on Construction Sites

The lack of fall protection on a construction site in Tucson is a common cause of construction site injuries. In fact, it is considered the top cause of death and serious injuries on construction sites all over the country. Most people expect that certain things will happen if someone dies or is seriously injured due to an Arizona construction site fall. Many people would expect that OSHA, or at least the Arizona arm of OSHA, would do a detailed investigation. Another expectation is that either the injured worker or the surviving family members have the right to file a workers’ compensation claim.

Many Arizonans do not realize that in addition to workers’ comp benefits an injured worker or surviving family members may also have the right to file a personal injury or wrongful death claim. These types of personal injury claims will not take away from the worker’ comp claim, but will actually add to what can be claimed.

Determining what caused an accident, such as why there was a lack of fall protection and why the fall occurred, along with a variety of different factors are part of what must be considered to ascertain whether a personal injury claim can be made as well.

For any questions about personal injury claims after construction site falls or falls on other job sites, please call us. Our Tucson construction injury lawyers are happy to help you and your family address the same concerns we have helped others in similar situations address. In that way, you can make the best decision as to how you wish to proceed I your construction site accident claim.

Who is Liable for Injuries or Wrongful Death in Arizona Construction Accident Cases?

The construction industry has the highest worker injury and fatality rates of any industrial sector in the United States although construction workers only make up a small percentage of the American workforce. The most common causes of fatal construction accidents in Arizona and elsewhere in the nation include unsafe equipment, defective or malfunctioning equipment, lack of proper training, not following safety procedures and negligence on the part of the employer or other parties involved in the construction project. Electrocution, scaffold collapse, trench collapse, burns or falling objects are also common causes of construction site accidents.

So, who is actually responsible when a worker is injured or killed in a construction accident? Under federal law, the prime contractor in charge of the project is always responsible for job safety on the entire site and for compliance with regulations and safety standards imposed by the Occupational Safety and Health Administration (OSHA). The main contractors are the ones who dictate work schedule, provide and help maintain equipment that is used at the work site. If the prime contractor delegates work to a sub-contractor, he or she is also responsible for job safety and following guidelines and safety standards.

When a worker is injured or killed, state workers’ compensation benefits cover lost wages and medical expenses associated with the injuries or deaths at the construction site. However, if the accident, for instance, was caused by a defective tool or piece of equipment, then a product liability lawsuit could be filed against the manufacturer of that faulty product that caused the injury or death. Workers are entitled to workers’ compensation costs in connection with both short-term and long-term injuries as well as catastrophic injuries such as loss of limbs. They could also receive compensation to cover vocational training and physical therapy.

If you have suffered serious injuries in a construction site accident in Arizona, please contact Breyer Law Offices P.C. to find out more information about your legal rights and options. Our experienced Phoenix accident attorneys will carefully evaluate your case, fight for your rights and make sure you receive just compensation for your injuries, damages and loss.

Arizona Construction Accident Lawyers Concerned about Trench Collapses

Trench collapses in Arizona are a major source of construction accident deaths. Between 1990 and 2000, there were 771 fatal accidents involving trenching and excavations in the United States. On average, 70 construction workers die each year while working in a trench. Some workers operate without even realizing that they could be digging their own grave. A hard hat in most of these cases may not offer that much protection if a trench wall collapses due to proper safety measures are not being taken. The real tragedy of trenching accidents is that they can be prevented.

Recently, a 25-year-old construction worker who was installing a storm sewer line about 10 feet underground was pinned to the sewer main and killed after the walls of the trench collapsed. According to a report in The Monitor, the young man was instantly killed. The man was apparently working for a private contractor. The federal Occupational Safety and Health Administration (OSHA) is conducting an investigation of the site in order to determine whether all safety protocols were followed.

Worker Falls to his Death in Construction Site

Falls continue to be a leading cause of Arizona construction accident injuries and fatalities. Such fatal construction scaffolding falls are usually caused by loose or unstable scaffolding, lack of fall prevention mechanisms or some type of slippage. Falls can result in catastrophic injuries including traumatic brain injuries and spinal cord injuries, which can essentially prevent a worker from having a livelihood for the rest of his life. This can be emotionally and financially damaging, not only to the worker, but to his entire family.

According to a recent news report, a construction worker was killed after he fell from scaffolding into a hole and was then buried by a large amount of soil. Officials say that the worker fell into the excavated hole while using a compactor 6 feet above the ground and 15 feet above the bottom of the hole. It is believed that the vibrations from the compactor caused the worker to lose his balance and fall into the hole.

Employers can be held accountable for on the job injuries and fatalities when they fail to provide safe work conditions. The Occupational and Safety Health Administration (OSHA) can slap employers with serious citations and fines if they are found to have been negligent. Arizona employers are required under state and federal law, to provide safe work conditions for their workers. In such cases, victims' families have the legal right to pursue compensation for their tremendous loss. If negligence is found on the part of the contractor or a sub-contractor (an entity other than the employer), there is the potential for third-party claims as well.

Preventing Arizona Injury Accidents at Construction Sites

One of the most dangerous places to work is at a construction job site, and one of the most common injury accidents in Arizona to occur on a construction site is falling. One third of construction accident deaths are attributed to falls. For this reason, knowing about your rights when it comes to injuries and deaths related to falls on construction sites is important for anyone affected by these accidents.

There are a number of factors that cause falls at a construction site. As the average construction site is so often full of debris and uneven surfaces, and frequently will include multiple levels of scaffolding or other structures, it is no wonder that falls are so common on construction sites. Uncovered holes or wall openings can create falling hazards, as can unprotected ledges or sides of buildings. Ladders that are not set up properly or that are not well maintained can lead to a slip and fall. Poorly built or maintained scaffolding may lack protection necessary to keep workers safe. Exposed material such as concrete, rebar, electrical wires, or other materials can pose additional hazards and cause greater injury to a worker who falls at a construction site. Even if a worker does not fall, a falling object can be dangerous to a worker and can cause serious injuries.

Falls can often be fatal for construction workers. Yet even if a worker does not die, there is still a real chance of permanent disability from a fall at a construction site. Some injuries that result from falls on construction sites include:

  • Paralysis

  • Nerve damage

  • traumatic brain injury

  • Amputation

  • Broken bones

  • Minor injuries (bruises and scrapes)

Peoria Construction Accident Attorney Can Help Injury Victims

Far too often, as Phoenix personal injury attorneys, we see wounded, even permanently impaired, Arizona construction workers who never avail themselves of their rights under the personal injury system. Many construction site accidents are caused by other subcontractors or workers at the jobsite who fail to follow OSHA standards and other laws related to workplace safety. Disregarding acceptable standards of caution in a construction trade, and causing injury to someone else, often opens the floodgates for claims to be made in addition to workers' compensation. This happens without forfeiting any available rights pertaining to the workers' compensation claim. Personal injury claims are made in addition to, not instead of, the workers' compensation claim.

It is important not to allow the type of construction accident that has occurred to get in the way of a proper analysis. There is no restriction that dictates which types of construction accident allow personal injury claims to be brought. That’s why it’s vital to find a skilled attorney to review a claim and see if more compensation can be sought outside of workers' compensation.

Understanding Various Causes of Accidents on Construction Sites

Causes for construction accidents vary and are dependent on the type of job. Dangers include falling objects, working with live electricity, explosive chemicals, equipment failures, and injuries relating to slips and falls. These tend to be the most common type of construction related injuries.

The causes of accidents can be attributed to negligence on the part of general contractors, sub-contractors, vendors, and employees. Such are the extreme dangers that exist on almost every job site throughout the country, which can often lead to construction accidents that then can cause life-threatening conditions. Accidents on construction sites may require reconstructive surgery or amputation, or even result in serious brain injury. Some other incidents may leave construction workers with lifelong conditions that disfigure their bodies and negatively impact their ability to work or even pay for their own care.

Though workers’ compensation may cover a lot of the injuries associated with construction accidents, the monetary value of many workers’ compensation claims are not enough to provide for all the damages that are associated with meeting the workers’ fiscal responsibilities associated with the accident.

Photos Crucial to Jobsite Accident Claims

In a construction accident in Arizona, a photograph may be the difference between prevailing over a devastating injury and facing financial ruin.

Construction accident claims in Arizona aren’t simple. Many hurt in construction accidents seek reimbursement only from workers’ compensation. In plenty of cases, workers’ compensation in Arizona is the only possible recovery. However, workers hurt in construction trades are able and entitled to bring a claim against a third party who negligently caused the injury. Most Arizona construction workers don’t know they may have the right to bring this claim. Since they don’t know their rights, they fail to get photo evidence at the job site.

Construction sites change quickly and evidence can be destroyed or altered within moments. It’s vital to inform anybody who has suffered a jobsite injury that photographs of the site must be taken immediately.

Tucson Man Electrocuted on Work Site

Too many Arizona construction workers suffer serious injuries without seeking aid from the best Arizona construction accident attorney because they don’t know their rights. All too often, those seriously hurt on the job look only to workers' compensation as the most direct remedy after on-the-job injuries.

However, workers' compensation does not pay full wages. Workers' compensation provides no money for the loss of enjoyment of life, pain, and other general damages available in a personal injury situation.

Though not every worksite injury merits a personal injury lawsuit, anyone impaired in an accident should take immediate steps to contact a lawyer who is aware of exceptions to the rule limiting compensation to workers' compensation claims only. And bringing a personal injury lawsuit against a negligent party does not prevent a workers' compensation claim-- many clients have utilized our expertise in construction accident law in Arizona to make sure they get compensation beyond workmen's comp payments.

For instance, on February 10, 2009 it was reported in an article that a 61 year old worker at a Tucson construction site was electrocuted while he was setting a pole near power lines. Whether this worker can bring a claim outside of workers' compensation is unknown, but we strongly encourage this worker and anyone else injured in Arizona construction accidents to seek out a Phoenix construction accident attorney to do a full analysis to indicate whether or not more money is available under the law to help them through such a terrible and tragic event.

Concrete Beam Crushes Construction Worker to Death

According to an article, work at a bridge construction site was halted after a worker was crushed to death by a concrete beam. According to investigating officials, the worker was tethered to the concrete beam when the beam collapsed and crushed him to death. After conducting an investigation of the construction accident death, officials said that the concrete beam collapsed because someone had welded couplers to a rod that held together a temporary brace. The welding weakened the rods to the point that they were no longer strong enough to hold the weight of the beam, which lead directly to the beam falling and crushing the worker to death.
